Potato Jam mobile games
Terms of Use & Software License
Including end-user licensing provisions
On this page
1. Who operates the Games
These Terms of Use and Software License (the “Terms”) apply to mobile games published under the Potato Jam brand by Nadzeya Roshchyna, an individual entrepreneur established in Poland (“Potato Jam”, “we”, “us” or “our”), when the relevant game or its store listing links to these Terms (each a “Game”).
Business address: Karlinskiego 4, 01-262 Warsaw, Poland. Tax identification number (NIP): 5252879201. REGON: 520111866. Email: info@potatojam.com. Website: https://potatojam.com.
These Terms concern our mobile Games, not third-party products, advertisements or websites. Additional game-specific terms, where expressly disclosed, apply only to that Game and do not override mandatory law.
2. Availability of the Terms and how the service works
We make these Terms available free of charge through our website, relevant app-store pages or the Game, so that you can read, save and reproduce them. Please review them before playing. Where applicable law requires acceptance or additional pre-contractual information, we will provide it through the relevant purchase or service flow.
Games may be downloaded and played without mandatory player-account registration. A Game may offer free gameplay, advertising, optional purchases of digital content or currency, and other features described in its store listing or in-game. Certain features require an Internet connection, a compatible device or an operating-system update. You are responsible for charges imposed by your Internet or mobile provider. The relevant store listing and in-game descriptions explain major technical requirements and functionality.
Free gameplay begins when you start using the Game on the basis of these Terms, to the extent permitted under applicable law. A paid purchase is made under the separate checkout process and applicable store terms.
3. Intended audience and minors
Our Games are designed and marketed primarily for adults. They are not designed or specifically marketed to children. A content rating (for example, PEGI) concerns content suitability and is not the same as the intended target audience. We do not require an age screen as part of ordinary guest gameplay.
If you are under the age of legal majority where you live, ask a parent or legal guardian to review these Terms and obtain any authorization required for purchases or other legally significant actions. We do not treat use of a Game or viewing a rewarded advertisement as proof that a minor has given legally valid consent to the processing of personal data. Our Privacy Policy explains the additional protections that may apply to minors.
4. Limited license to use our software
Subject to compliance with these Terms and the applicable app-store rules, we grant you a limited, personal, non-exclusive, non-sublicensable and non-transferable license to install and use the Game for personal, non-commercial entertainment on devices you own or control. The license lasts for as long as we lawfully provide the Game to you and may end in accordance with these Terms and mandatory consumer law.
All copyright, trademarks, art, music, software, visual assets and other intellectual property in the Games remain owned by Potato Jam or its licensors. Purchasing digital content does not transfer ownership of the software or its intellectual property. You may not resell or sublicense the Games. Nothing restricts rights to examine, make permitted copies of or otherwise use software that cannot lawfully be waived.
For Games downloaded through Apple, the Apple Standard Licensed Application End User License Agreement applies as the app-store license unless we separately submit and make available an Apple-approved custom EULA. These Terms supplement that license only to the extent consistent with it and applicable law.
5. Fair play and acceptable use
You must not cheat or use unauthorized bots, scripts, exploits or technical manipulation to obtain rewards, interfere with the Game or its security, falsify purchase receipts or rewarded-ad completion, compromise others’ devices, or use the Game unlawfully. You must not copy, distribute, modify, extract, decompile or reverse engineer the Game except where mandatory law permits it.
We may take reasonable and proportionate action to prevent abuse, correct fraudulently obtained balances or protect Game integrity. Where actions affect paid content or user rights, any notice, review opportunities and consumer protections required by law continue to apply.
6. Guest play, game progress and backups
Players generally play as guests without creating a Potato Jam account. Progress may be saved locally on the device or through services made available by a device or app-store provider, depending on the Game. Unless the Game expressly offers cloud backup or cross-device restoration, progress may be lost after deleting the app, clearing device data, changing devices or device failure.
If you cannot access an in-app purchase, please contact us with the Game name, platform and transaction information sufficient to investigate. Do not send your password or full payment-card details. We will handle paid entitlements and restoration problems consistently with your statutory consumer rights.
7. Virtual items and in-game currency
Games may provide coins, energy, lives, boosters, cosmetic elements or other digital benefits (“Virtual Items”) through gameplay, purchases or rewarded ads. Unless expressly stated otherwise, Virtual Items are usable only within the applicable Game; they are not cash, are not redeemable for money, and may not be traded or transferred for real-world value.
When you purchase Virtual Items, you receive the described digital functionality or content, not legal ownership of any intellectual property. We will provide material information, including quantity, price, functionality and important restrictions, before checkout. We may rebalance free gameplay and rewards for legitimate reasons but will respect your legal rights regarding paid digital content and digital services.
8. Purchases, payment and refunds
In-app purchases are optional. The app store or other authorized payment provider displays the applicable price, taxes, purchase contents and billing terms before confirmation. Payment is ordinarily processed by Apple or Google rather than by Potato Jam directly; the identity of the seller or merchant of record should be determined from the actual checkout and receipt.
Refunds may be processed through the store according to its procedures. You may also contact info@potatojam.com about delivery, quality or restoration. These Terms do not remove any mandatory right to a remedy for digital content or digital services that do not conform to your contract.
Where consumers have a statutory right to withdraw from a distance contract, an exception for digital content supplied immediately without a physical medium only applies if the legally required conditions have actually been satisfied, which may include express prior consent, acknowledgment of the loss of the withdrawal right and confirmation. Merely using these Terms does not constitute that consent or acknowledgment.
9. Advertisements and optional rewarded ads
Games may show advertisements supplied through Google AdMob and participating advertising providers. Certain advertisements can be watched voluntarily in exchange for a clearly described in-game reward. A reward is normally issued when the required playback or verification condition is satisfied. Availability depends on the network, device and advertising provider.
If you completed an ad offer but did not receive the stated reward, email info@potatojam.com with the Game name, approximate time and sufficient information to investigate. We will investigate reasonable reports and correct verified failures where appropriate.
Watching an advertisement or requesting an in-game reward is not consent to personalized advertising, analytics or tracking. Required privacy choices are handled separately as explained in our Privacy Policy. Advertising can be restricted by privacy law, device permissions, user choices and store policies.
10. Updates, interruptions and changes to Games
We may release updates to maintain security, fix defects, improve compatibility, add features or adjust game balance. Some updates are necessary for continuing operation. We may temporarily interrupt a Game for maintenance, security or reasons outside our reasonable control.
Where law requires us to provide digital-content or service updates, advance notice of material modifications, or remedies if a change adversely affects a user, those requirements apply. We will not use a general modification clause to deprive users of mandatory rights regarding paid digital content.
11. Complaints and customer support
You may submit a complaint or support request by emailing info@potatojam.com. Please give the Game title, device or platform, a description of the issue, approximate date, and your requested outcome; include an order reference if the issue relates to a purchase. We may ask for further information reasonably needed to handle the request.
We will respond without undue delay and within any deadline imposed by applicable law, including applicable Polish consumer-law complaint deadlines. Using an app-store refund or complaint channel does not deprive you of any rights you have against the responsible trader under applicable law.
12. Privacy and third-party services
Our Privacy Policy explains the personal-data processing connected with Games, including Firebase Analytics, Firebase Crashlytics, Firebase Remote Config and Google AdMob. Device platforms, app stores, ad providers and linked third-party websites may have their own contractual and privacy terms. You must comply with applicable third-party terms when using their services, including network-provider terms.
We are responsible for our own duties under applicable law; external ads or links are not an endorsement of every offer or claim made by a third party.
13. Termination, suspension and availability
You may cease using a Game at any time by uninstalling it. This does not automatically cancel any app-store subscription you may separately hold or remove all third-party data, nor does it eliminate existing legal rights concerning a purchase.
Where reasonably necessary to address fraud, serious misuse, security issues or unlawful conduct, we may limit access to a Game to the extent law permits. We may discontinue a Game, but the handling of paid content, required notice, refunds and other remedies remains subject to applicable law.
14. Warranties and responsibility
We aim to provide functioning Games and reasonable support, but a digital service may experience defects, interruptions or device-specific issues. To the extent permitted by law, we do not guarantee uninterrupted service or that every free feature will remain available forever.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including mandatory consumer rights and remedies, liability for deliberate misconduct or other non-excludable liability. Any further limitation operates only as far as the law applicable to you permits.
15. Governing law and dispute resolution
Polish law governs these Terms, except that this choice does not deprive a consumer habitually resident elsewhere of mandatory protections under the law that would apply without this choice. Courts with jurisdiction under applicable consumer and private-international-law rules may hear disputes. We do not require consumers to bring claims exclusively before a Polish court where prohibited.
You may contact us at info@potatojam.com to seek an amicable solution. Statutory alternative dispute-resolution channels may be available to consumers in relevant countries.
16. Changes to the Terms
We may revise these Terms for legal, security, technical or reasonable operational reasons. When required, we will give advance notice, obtain agreement or provide statutory remedies. An updated version will carry a revised date and will not retroactively remove rights already acquired under mandatory law.
